Probate
Probate is the court process admitting a will and appointing an executor or personal representative (PR) to give the PR the authority to transfer the decedent’s assets in accordance with their will.

Estate Disputes
In some situations, disputes arise regarding how a decedent’s executor is handling an estate. There may be questions regarding the decedent's intent when it came to the terms of his will, or there may be questions about other aspects of the probate process that will lead to litigation. When that happens, it’s important for a potential claimant to consult with an attorney to either determine if you have a claim and represent you in litigating that claim or if someone makes a claim against you, it’s important to have an attorney defend you in that litigation.

Guardianship
A guardianship is a process where a party asks the Court to appoint someone to be a guardian for someone to manage his/her personal care and/or his/her finances. This may come about for a minor under the age of 18 or for an adult who becomes disabled as a result of injury, illness, or old age. (Some issues regarding guardianships are discussed in the estate planning section.)
